Legal

The rules of the game, spelled out.

These terms govern the use of the KONECT site and service. They apply as soon as you open an account or use an accessory. The terms of sale have their own page.

What this document covers

This document governs access to the KONECT site, to your dashboard, to public profiles and to the accessories that point to them. By creating an account or using the service, you accept these terms.

Buying an accessory or a subscription falls under the terms of sale, which add to these without replacing them. The handling of your data falls under the privacy policy.

Your account

An account is personal. You are answerable for what happens on it, and therefore for the confidentiality of your password. Tell us without delay if you suspect access that is not yours.

The information you declare must be accurate — it is what we rely on to deliver an order or check a claim.

You must be at least thirteen. Between thirteen and eighteen, the agreement of your parent or guardian is required.

What you publish

What you put on your profile is yours and stays yours. We claim no ownership of it.

You grant us only the technical right to host, reproduce and display that content, strictly as far as running the service requires — and that right ends when you remove the content.

You warrant that you have the right to publish what you publish: a company logo, a photo taken by someone else, a registered trademark bind whoever puts them online.

What we do not accept

A KONECT profile opens with no account and no installation. That ease imposes clear limits.

  • Passing yourself off as someone else — impersonating a person, a company or a role.
  • Publishing unlawful content — hateful, defamatory, fraudulent, sexually explicit, or infringing a third party's rights.
  • Diverting the service — phishing, distributing malware, misleading redirection.
  • Circumventing security — attempting to reach data that is not yours, probing the limits of the service, brute-forcing an identifier.
  • Scraping the service — extracting profiles or contacts automatically, in bulk.
  • Reselling access — commercialising the service without written agreement. The reseller programme exists for that.

If you come across any of these uses, report it: the contact form has a reason for exactly that.

The accessory and the link it carries

The object you buy is yours. The link it carries depends on your account: you can attach it to another profile, suspend it, or revoke it for good.

An accessory bought by an organisation stays under that organisation's control: when a member leaves, their accessory stops opening the profile, with no reprint.

A revoked accessory is not broken — it simply opens nothing until a profile is attached to it again.

Availability of the service

We aim for a permanently available service and a profile that opens in under two seconds, including on a slow network. Those are goals held up by the architecture, not a contractual uptime commitment.

Interruptions can happen: maintenance, a provider outage, a network incident. Scheduled maintenance is announced when it is foreseeable.

The service may evolve. A feature removed or significantly changed is announced before it goes.

Suspension and closure

You can close your account whenever you like, from your settings. Closing it cuts the profiles and the links carried by your accessories.

We may suspend or close an account that breaks the rules above, or whose use endangers the service or its users. Except in an emergency or where the law requires otherwise, we warn first and explain why.

A subscription running at the time of a closure on our initiative is refunded pro rata for the unused period.

Liability

The service is provided as it works. We do not warrant that it will meet every use one might imagine, nor that it will be free from interruption.

We are not answerable for content published by users, nor for what a third party does with contact details you chose to make public.

To the extent permitted by law, our liability under the service is limited to the amounts you paid us over the preceding twelve months. Nothing here limits the rights the law grants consumers, nor our liability for gross negligence, wilful misconduct or personal injury.

Governing law and disputes

These terms are governed by the law of the Province of Ontario and applicable Canadian federal law. The courts of Ontario have jurisdiction.

If you are a consumer and your habitual residence entitles you to the protection of your province's or country's law, that protection remains yours.

Before any other step, write to us: most disputes are settled in a single exchange.

Changes to these terms

These terms may change. The applicable version is the one published on this page, bearing the date shown at the top.

A substantial change — a new obligation on you, a restriction of a right — is announced to you by email at least thirty days before it takes effect. Continuing to use the service after that date counts as acceptance; otherwise, you may close your account.
